Off topic, Diane, you may have missed a major trial decision from a couple weeks ago in the school-funding case filed by eight New York towns as a follow-up to the Campaign for Fiscal Equity litigation. I just got around to reading it. The plaintiffs alleged that the New York state deprived students in the plaintiffs’ eight school districts of their constitutional right to a sound, basic education by not adequately funding the school districts. The case was based on the premise that the state has a constitutional obligation to pay the full $5.5 billion of “Foundation Aid” provided for by the 2008 budget. Essentially, this is the basis of the idea that the state owes the schools $5 billion, that the state is violating the CFE ruling, etc. The court rejected the entire argument, held that the state did not have a constitutional obligation to pay the full $5.5 billion, and dismissed the case.
